Youtube summoned for copyvio
This is interesting law case. Productiehuis Farmhouse TV & Film has ordered Youtube to pay 200.000 euro because there movie Redbad was uploaded on Youtube by someone unknown. And youtube had displayed commercials in it. They are even talking about een strafbaar feit, a criminal offence.
Youtube used the well known Silicon argument, we are just a platform, and are because of that we are not responsible. They can inform us and then we will remove the content. The good old section 230 story.
This is the first time there is such a trail and I don't know the details, but for sure it will generate interesting jurisprudence. Because it will answer the question if a platform in Holland/Europe is responsible for the content, yes or no.
And for the record, this has noting to do with the new EU section13, this is local Dutch copyright where it is about. And it is my old claim Wikipedia is under Dutch law in Holland and can't hide itself behind section 230 in Holland. And it is the reason why I am trolled out with a SanFanBan by the Duch/Belgium cabal.

Yes this is very interesting, it is pretty much the first time a European court has gone against an internet giant (Youtube is owned by Google) so this is will be very relevant.

It is. Special because there is a kind of informal European jurisprudence, so there is a huge change every (continental) European judge will follow it in the future. And indeed because Youtube is a part of Google.

And I think it is no coincidence this first law case is in Holland with it's extreem strict copyright regulation. I said it before, shoplifting is a much better idee in the Netherlands than taking one 200PX picture without permision...
It is 100 % for sure Youtube will lose this case, for the simple reason a Dutch judge has to follow the law. He is in Holland a servant of the king. Every law in Holland is in name of the king or queen and sign by our king and before by the our queen. Copyvio is stick forbidden, so no mercy, you have always to pay.

It is clear this guy has not any idea about European copyright....... Because it IS already forbidden to have the smallest part of copyvio in your work! From 1912 on in Holland.
There is nothing new, we never had a take down system, but a pay or I sue you system. The EU can't change that! It is national, existing legalisation.

lol, there are MILLIONS of copyright violations on YT at any time. And I don't mean snippets of TV shows and movies, I mean full works. Usually obscure or old stuff that might or might not be "abandoned". Plus god knows how many thousands of hours of "free" music. It all gets deleted and reuploaded over and over.
One of the dirty little secrets of online video isn't YouTube content itself. It's the automated YT content ripper websites. There have been literally dozens of them. Just punch in the YT URL and you can DL and save the video on your hard drive. People in Hollywood REALLY hate that. Google and MPAA lawyers go around killing them off. Then new ones pop up.
